    1. The owner of the online store operating under the address serwisgeberit.pl is the company Montaż i Serwis Hydromasaży Tomasz Borzym, headquartered in Suwałki, 16-400, at Knuta Olofa Falka Street 1/34, NIP: 848-129-61-12, REGON: 790661474, phone number: 603-805-900, email address: biuro@serwisgeberit.pl or biuro@603805900.pl.
    • 2 Store Offer
    1. The subject of transactions conducted through the online store consists of the products listed in the offer, as presented on the website serwisgeberit.pl at the time of placing the order.
    2. All product prices in the store are quoted in Polish zlotys and include VAT (gross prices).
    3. The products offered in the store are brand new and have the necessary certifications and permits required for distribution in Poland.
    4. The content of the online store does not constitute a commercial offer within the meaning of Article 543 of the RP Civil Code.
    5. All mentioned products and names are used for identification purposes and may be registered trademarks of their respective owners.
    6. The images used for product presentation belong to the owner of serwisgeberit.pl and, as such, may not be copied or shared by third parties without permission.
    • 3 Orders
    1. Orders may be placed by an adult individual or a company registered in Poland. Orders in the Online Store serwisgeberit.pl can be placed through:
    • Completing the order form available on the product page;
    • Sending an email with order details to the store’s email address: biuro@603805900.pl;
    • Contacting the store by phone at the numbers provided on the website: 603-805-900.
    1. Placing an order is equivalent to consenting to the storage and processing of personal data provided in the order by MiSH Tomasz Borzym, in accordance with applicable personal data protection regulations (Dz.U.Nr 133 poz. 883).
    2. Orders for expensive, non-standard, hard-to-sell, or custom-made products will be processed only after a down payment of at least 20% has been made.
    • 4 Order Processing
    1. Every order placed in the Online Store serwisgeberit.pl must be confirmed by the seller. To this end, our system sends a confirmation email to the email address provided in the order. Additionally, within two business days of placing the order, a store representative will contact the customer by phone or email to confirm the order and agree on further transaction details.
    2. If the order cannot be confirmed due to the buyer's fault (e.g., incorrect phone number, no response to the confirmation email), the order will be canceled:
    • Within 48 hours of placing the order;
    • If no payment is received for orders requiring prepayment within two days.
      Any personal data included in the canceled order will be deleted from the store’s database.
    1. Ordered goods will be delivered within seven business days from the order date. An exception applies to products with low sales volume or those specially ordered for the customer, in which case the delivery time is agreed upon individually.
    2. By placing an order, the buyer authorizes the Online Store serwisgeberit.pl to issue an invoice without requiring the buyer's signature.
    3. Upon confirmation of order acceptance, a sales contract is concluded between the buyer and the Online Store serwisgeberit.pl.

    The sales contract may only be concluded in Polish.

    • 5 Transport, Delivery Costs, and Payment Methods
    1. The delivery cost depends on both the payment method chosen by the customer and the product's weight.
    2. For shipments exceeding 30 kg in weight or non-standard parcel deliveries, the shipping cost is determined individually. It depends on the delivery location and the selected courier service.
    3. For orders exceeding 12,000 PLN (excluding shipping costs), serwisgeberit.pl covers the domestic shipping costs. However, the shipping method is determined by the store in agreement with the customer.
    4. The delivery of products ordered from the serwisgeberit.pl Online Store is available only within the territory of the Republic of Poland.
    5. Depending on the order value, selected delivery method, and personal preferences, customers can choose from the following payment methods:
    • Bank Transfer – Payment should be made to the bank account number provided in the email confirming the order. The transfer can be completed online, at a post office, or at a bank. Once the payment is credited to our account, we will begin order processing.
    • Fast Payment – Payments can be made via Shoper and Przelewy24. Once the payment is credited to our account, we will begin order processing.
    1. Available payment methods include:
    • Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.
    1. In the event of a refund for a transaction made by the customer using a payment card, the seller will refund the amount to the bank account associated with the buyer’s payment card.
    2. Online payment processing via fast transfers is provided by PayPro S.A.
    3. Online payment settlements are handled by Autopay S.A. (autopay.pl).
    • 7 Delivery Time
    1. Domestic shipments are delivered via the following courier services: UPS, DHL, KEX, and InPost’s Paczkomaty.pl. For non-standard shipments or packages exceeding 30 kg, the carrier may change. The delivery time depends on the selected shipping option:
    • UPS Courier: Average delivery time is 1-2 days. The shipment status can be tracked on the website:
      UPS Tracking by entering the tracking number in the "Monitoruj" field.
    • DHL Courier: Average delivery time is 1-4 days. The shipment status can be tracked on the website:
      DHL Tracking by entering the tracking number in the "Numer Przesyłki" field.
    • KEX Courier: Average delivery time is 1-4 days. The shipment status can be tracked on the website:
      KEX Tracking by entering the tracking number in the "Track & Trace" field.
    • InPost Paczkomaty.pl: Average delivery time is 1-3 days. The shipment status can be tracked on the website:
      InPost Tracking.
    • For "Made to Order" products, non-standard shipments, or packages exceeding 30 kg, the exact delivery time will be provided individually after the order is accepted, based on the order processing time.
    • 8 Returns
    1. A customer who has entered into a distance contract has the right to withdraw from the contract without giving any reason by submitting a written statement on the store’s website in the "I WANT TO RETURN" section within 14 days. This period is non-extendable and is counted from the day the customer physically receives the goods or when a third party (other than the carrier) designated by the customer takes physical possession of the goods.
    2. In the case of purchases made by companies with a VAT invoice, returns are only possible after prior agreement with the store.
    3. The customer also has the right to withdraw from the contract before taking physical possession of the goods (after placing an order).
    4. During the withdrawal period, the customer should handle the goods only to the extent necessary to determine their nature, characteristics, and functionality, as they would in a physical store.
    5. If the customer uses the goods beyond what is necessary to determine their characteristics and functionality, they lose the right to withdraw from the contract.
    6. The right to withdraw from the contract is also lost if the order requires an international shipment.
    7. The return must be made immediately, but no later than 14 days after informing the seller of the decision to withdraw from the contract. The purchased goods must be returned to the seller’s address.
    8. The customer bears the return shipping costs in the event of contract withdrawal.
    9. The seller does not accept returns sent "cash on delivery".
    10. Upon receiving the returned goods, the seller will inspect them to confirm that they have not been used beyond what is necessary to determine their characteristics and functionality.
    11. The seller may deduct from the refund amount any costs related to packaging and securing the goods for shipment.
    12. The seller will refund the customer the paid amount (value of the returned goods and the cost of the cheapest available delivery option) within 14 days. The refund will be issued via bank transfer to the account specified by the customer. For instant payments, the refund will be processed through the same payment method used by the customer, or via postal money order (with the refund amount reduced by the money order fee) to the address provided in the order.
    13. The seller may withhold the refund until the goods have been received or until the customer provides proof of return shipment, whichever occurs first. For VAT invoice returns, a signed correction document must be sent back.
    14. The right to withdraw from the contract does not apply to agreements specified in Articles 33, 34(2), and 35 of the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827), including but not limited to:
    • Services that have been fully performed with the customer's prior consent, where they were informed before the service began that they would lose the right to withdraw upon completion.
    • Goods whose price depends on financial market fluctuations beyond the seller’s control.
    • Custom-made goods produced according to the customer’s specifications or tailored to their individual needs.
    • Perishable goods or items with a short shelf life.
    • Sealed goods that, once opened, cannot be returned due to health protection or hygiene reasons.
    • Goods that, after delivery, become inseparably mixed with other items due to their nature.
    • Alcoholic beverages whose price was agreed upon at the time of sale but can only be delivered after 30 days, with their value depending on market fluctuations.
    • Urgent repairs or maintenance requested by the customer, unless additional services or non-essential spare parts are included.
    • Sealed audio or video recordings or computer software once their packaging has been opened.
    • Newspapers, periodicals, or magazines (except for subscription contracts).
    • Goods purchased via public auction.
    • Accommodation services (except for residential purposes), transportation of goods, car rentals, catering, leisure services, or tickets to entertainment, sports, or cultural events, where the agreement specifies a fixed date or period of service.
    • Digital content not supplied on a physical medium, where performance has started with the customer’s explicit consent before the withdrawal period ended, and the customer was informed of the loss of the right to withdraw.
    • 9 Complaints
    • The seller undertakes to deliver goods to the customer in accordance with the contract and free from defects.
    • Depending on the product, the goods are covered by a one-year or two-year warranty, except for electric heaters, heater cartridges, light bulbs, and other products where different warranty conditions are explicitly stated (e.g., clearance items or spare parts).
    • Every product purchased in our store is brand new and comes with a warranty from an authorized service center for the respective brand in Poland. The warranty period depends on the manufacturer. In case of equipment failure, the customer should contact one of the authorized service centers in Poland, as listed in the product’s warranty card.
      In most cases, our company also provides service for the sold products, which simplifies and speeds up the complaint process.
    • Upon receipt of the goods, the buyer is obligated to inspect the shipment within 7 days of delivery. Any external damage should be immediately reported to the personnel present during delivery or to the courier and communicated to MiSH sales representatives.
      • The response time for a reported complaint is 2 business days.
      • The processing time for complaints (replacement or repair) is as fast as possible and in most cases does not exceed 14 business days.
      • For complaints regarding low-turnover products (special orders), the processing time depends on the supplier’s stock availability.
      • The resolution time may be extended depending on product availability in the suppliers' warehouses.
    • If the customer discovers that the purchased product has physical defects or does not conform to the contract, they have the right to file a complaint with the seller.
      • To file a complaint, the customer should send an email to sklep@603805900.pl, including:
        • Manufacturer details
        • Product model
        • Purchase date
        • Date of defect occurrence
        • Description of the defect
      • The seller is liable for product defects and non-conformity with the contract only if they are identified within two years from the date of delivery to the customer.
      • The seller does not accept complaint shipments sent "cash on delivery".
      • Complaints related to the purchase process (e.g., incorrect delivery charges or incorrect quantity of goods) can be submitted via email to sklep@603805900.pl.
      • The seller will review the complaint within 14 days from the date of submission.
        • If the complaint is resolved in favor of the customer, the seller will either repair or replace the defective product with a new, fully functional one or refund the customer (including the value of the returned product and the original shipping cost).
        • The refund will be processed within 14 days via bank transfer to the account specified by the customer or via postal money order to the address provided in the order.
        • Regardless of the resolution method, the seller will also cover the cost of returning the defective product.
        • 10 Privacy and Security Policy

    Privacy Policy

    1. The administrator of the personal data of Users of the Service operated at the address serwisgeberit.pl is the company Montaż i Serwis Hydromasaży Tomasz Borzym, headquartered in Suwałki (16-400), ul. Falka 1/34, NIP 8481296112, REGON 790661474, phone number: 603-805-900, email address: sklep@603805900.pl (hereinafter referred to as the “Online Store of Montaż i Serwis Hydromasaży”).
    2. The User has the right to access and rectify their personal data by contacting the Online Store of Montaż i Serwis Hydromasaży, for example, via email at sklep@603805900.pl or through the contact form.
      Minors or persons with limited legal capacity may enter personal data (and use the services of the Online Store of Montaż i Serwis Hydromasaży) only if they have reached the age allowing them to independently consent to the processing of their personal data.
    3. Every natural person has the right to obtain information on whether and what personal data concerning them is being processed by the Online Store of Montaż i Serwis Hydromasaży. They also have the right to access their data and request its rectification, deletion, or restriction of processing. Additionally, they have the right to object to the processing of their data, the right to data portability, and the right to withdraw their consent at any time. Withdrawal of consent takes effect from the moment the Online Store of Montaż i Serwis Hydromasaży receives the statement of withdrawal.
    4. Every natural person has the right to request the immediate deletion of their personal data if:
      a) their personal data is no longer necessary for the purposes for which it was collected by the Online Store of Montaż i Serwis Hydromasaży or otherwise processed;
      b) the consent on which the processing is based has been withdrawn and there is no other legal basis for the processing;
      c) they object, as mentioned in point 7, and there are no overriding legitimate grounds for processing, or if their personal data has been processed unlawfully.
    5. Every natural person may request a restriction on the processing of their personal data if, in their opinion, the data is incomplete or incorrect. In such cases, until the request for rectification is reviewed, the Online Store of Montaż i Serwis Hydromasaży will not process this data.
    6. Every natural person has the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office – if they believe that their rights related to personal data protection have been violated.
    7. Every natural person has the right to object to the processing of their data by the Online Store of Montaż i Serwis Hydromasaży when the processing is based on the legitimate interest of the Online Store. In such a case, the Online Store of Montaż i Serwis Hydromasaży will cease processing the data unless there are other legal grounds for further processing.
    8. Every natural person, upon request, may receive their personal data in a structured, commonly used, machine-readable, and interoperable format. They also have the right to request that the Online Store of Montaż i Serwis Hydromasaży transfer this data to another administrator, provided that:
                  a) the processing is based on the person's consent or a contract; and
                  b) the processing is carried out in an automated manner.
    9. Every natural person may request a restriction on the processing of their data in the following cases:
      1. They contest the accuracy of their personal data – in such cases, the Online Store of Montaż i Serwis Hydromasaży will suspend processing for a period allowing verification of the data’s accuracy.
      2. The processing is unlawful, but the User opposes the deletion of personal data, requesting instead the restriction of its use.
      3. The Online Store of Montaż i Serwis Hydromasaży no longer needs the personal data for processing purposes, but the User requires it to establish, pursue, or defend their claims.
      4. The User has objected to the processing – in such cases, the Online Store of Montaż i Serwis Hydromasaży will cease processing until it is determined whether the legitimate legal grounds for processing override the grounds for the objection.
    10. Users' personal data is collected via the website https://serwisgeberit.pl. The Online Store of Montaż i Serwis Hydromasaży may process personal data for direct marketing purposes based on its legitimate interest in marketing its own services or only with the consent of the data subject. This consent can be withdrawn at any time. Additionally, the individual has the right to submit a written, reasoned request to stop processing their personal data due to their specific situation or to object to such processing.
    11. Personal data is processed by the Online Store of Montaż i Serwis Hydromasaży for the following purposes:
      1. The provision of services by the Online Store of Montaż i Serwis Hydromasaży via the Website and Software, including, in particular, access to electronic publications (such as user manuals, control software for sold devices, etc.) (Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as "GDPR")). The processing of personal data for this purpose is based on the User’s acceptance of the terms and conditions, and processing in this regard is necessary for the performance of a contract or to take action at the request of the User. The Online Store of Montaż i Serwis Hydromasaży will process this data for the duration of the contract and for the period of limitation for potential claims.
      2. The sale of goods and services offered by the Online Store of Montaż i Serwis Hydromasaży (Article 6(1)(b) GDPR) – the processing of personal data for this purpose is based on the User’s acceptance of the terms and conditions and is necessary for the performance of a contract or to take action at the User’s request.
      3. Marketing purposes (marketing of goods and services by the Online Store of Montaż i Serwis Hydromasaży) (Article 6(1)(f) GDPR) – the processing of personal data for this purpose is based on the legitimate interest of the Online Store of Montaż i Serwis Hydromasaży. Data obtained from other sources or as a result of the User’s interaction with the Online Store of Montaż i Serwis Hydromasaży services – information about the website that redirected the User to the Online Store, identification number, brand, and type of device used by the User to access the services, purchased products, payment history, and transaction history.
    3. Providing personal data is voluntary but necessary for the execution of specific services by the Online Store of Montaż i Serwis Hydromasaży or its partners, as well as for establishing contact between the Online Store of Montaż i Serwis Hydromasaży and the individual.
    4. The Online Store of Montaż i Serwis Hydromasaży processes personal data in accordance with the security requirements set by applicable laws. These data are aggregated and anonymous. Anonymous operational data may be accessible to the entity providing the analytics service (e.g., Google).
    2. The Service and Software may contain links to other websites and content available outside the Service. The Online Store of Montaż i Serwis Hydromasaży advises Users to review the privacy policies of these external sites when navigating to them. The Online Store may allow third parties, such as advertising providers or analytics solutions, to collect information using these technologies directly on websites associated with the Online Store’s services. Data collected by these third parties are subject to their respective privacy policies.
    3. The Online Store of Montaż i Serwis Hydromasaży may share anonymized statistical data with its partners, clients, or contractors (e.g., the current number of active Users or the number of Users who have accessed a particular publication or shown interest in a specific topic).
    4. Personal data will be processed for the period necessary to fulfill the contract. After this period, the data will be retained for purposes and for the duration required by law, to secure potential claims (including claims by authors, publishers, and distributors of electronic publications mentioned in section 21), to allow the exercise of warranty rights and repairs of delivered goods and services, or until a specific consent is withdrawn.

In the event of unauthorized distribution of an electronic publication, the party whose rights have been violated (including the Online Store of Montaż i Serwis Hydromasaży) has the right to request the identification of the transaction through which the electronic publication was shared in order to determine the details of the entity that may have engaged in unauthorized distribution. Such a request may be submitted by a court or another entity handling claims from the party whose rights may have been infringed.       1. Optimize the use of the store’s pages (especially to tailor their content to the User’s preferences),
      2. Create statistics that help understand how Users use the store’s pages, allowing improvements to their structure and content,
      3. Maintain the User’s session (after logging in), so there is no need to re-enter the login and password on each subpage.

    • 12 Final Provisions
    1. All prices are quoted in Polish zloty (PLN) and include VAT, but do not include shipping costs.
    2. A fiscal receipt or VAT invoice is issued for each order. The receipt is generated when all ordered products are complete and ready for shipping. VAT invoices are issued upon the customer’s request. If an invoice is to be issued to a company, the Tax Identification Number (NIP) must be provided when placing the order. If the company's correspondence details differ from the invoice details, they should be entered in the designated field of the order form.
    3. By placing an order, the Buyer accepts the above regulations.
    4. Differences resulting from the individual settings of the customer's computer (such as color, proportions, etc.) cannot be the basis for a complaint regarding the purchased product.
    5. The content of the serwisgeberit.pl online store does not constitute a commercial offer within the meaning of Article 543 of the Civil Code.
